Probate is the legal process of going to court to settle the estate of a person who has died (known as a "decedent").  Our lawyers have over 39 combine years of practice experience, with a commitment to excellence and efficiency. • Probate Administration: Independent and dependent administration is where the court appoints a personal representative of an estate to gather the assets of an estate, pay the debts and distribute the remaining assets to the beneficiaries.  If the decedent left a will, the personal representative is usually named in the will and is known as the executor.  If the decedent died without a will, the personal representative is known as the administrator.
• Heirship: When a person in Texas dies without a will or in other situations, an heirship proceeding is necessary for the court to determine the lawful heirs.
• Other proceedings less complicated than the administration of an estate or an heirship such as Muniment of Title, Affidavit of Heirship and Small Estate Affidavits are options in some situations.
